Tradedmark Protection & Amazon Brand Registry

Are you a seller or would like to be a seller on Amazon? Here is an important announcement that will impact your business. In January 2020, Amazon changed their policy on brand registration. Amazon no longer requires a registered trademark to apply for their Brand Registry program. Sellers may now apply for registration with a pending trademark application, providing the seller protection weeks into the registration process, instead of waiting months for their trademark to be registered. This change is not specific to the United States and encompasses other countries too. Since the registration launch there has been a 99% reduction in infringement.

Benefits of Brand Registry with Amazon:

  • Provides the opportunity for new sellers to introduce their product to the market at a faster rate.

  • Amazon removes violators who are using your trademark.

  • Have access to Amazon’s Store, Enhanced Brand Content, and other sponsored brands.

  • Use Amazon’s search tool to find violators in other countries that are manufacturing your product without permission.

  • Access to Amazon’s 24/7 phone service in brand recognition.

Trademarks are obtained through the United States Patent and Trademark Office (USPTO). Applying for a trademark can be critical, particularly where the trademark will be used as the basis for Amazon Brand Registry. Therefore, seeking a trademark attorney’s help is recommended.
